A newsletter disclosure policy built on a relationship register

Build a newsletter disclosure policy that records relationships, owns wording and placement, works across formats and triggers correction or withdrawal.

A usable disclosure policy connects each commercial relationship to the exact newsletter material it affects. It names who decides the wording, where readers see it and what happens when the relationship or message changes. A generic footer is not the policy.

What to take away

  • A disclosure policy must link each commercial relationship to the exact newsletter material it affects.
  • Keep a relationship register with legal parties, consideration, control, affected editions and evidence owner.
  • Give the advertising reviewer authority over wording, location and timing of disclosures.
  • Preserve copy, destination, offer version, claims, evidence and approval date for each commercial module.
  • Reopen review when consideration, control, claim, audience, channel or landing page changes.

Keep a relationship register

Create one row for every sponsor, advertiser, affiliate merchant, gifted input and connected contributor. Record the legal parties, consideration, control, payable event, affected editions, start and end dates, rights, evidence owner and contract. Classify support or membership by what the payer receives rather than the label chosen by the publisher.

Relationship register fields

  • Legal parties
  • Consideration
  • Control
  • Affected editions
  • Start and end dates
  • Rights
  • Evidence owner and contract

CAP's affiliate guidance explains the link between performance-based reward, control and advertising scope. The policy should allow a partly connected edition to label the affected material precisely while preserving the distinction from independent editorial.

Own wording and placement

Give the advertising reviewer authority over wording, location and timing. State the actual relationship in terms an intended reader can understand. Put the notice where the commercial content begins or before the relevant action, then check the subject line and preview where necessary.

The CAP Code recognition rules say a reader must be able to recognise a marketing communication. Test the disclosure in the email, browser archive, plain-text version and assistive-technology reading order. A label supplied by a platform is a separate control, not proof that the newsletter placement is adequate.

Link claims to evidence

For each commercial module, preserve the copy, destination, offer version, objective claims, evidence and approval date. The CMA's endorsement collection is an official consumer-law resource for content creators and businesses. Do not imply personal use, independence or a customer result that the evidence cannot show.

Disclosure does not substantiate a claim, create copyright permission or fix an unfair customer term. Keep those review decisions separate.

Use a disclosure decision record

For each affected module, complete relationship | control | consideration | reader action | proposed words | placement | format | approver | evidence | expiry. Record the decision even when counsel concludes that a particular item is outside the advertising remit. That makes later changes visible.

Do not turn the record into a stock phrase library. Choose Advertisement, sponsored or another label for the real arrangement, then test it in context.

Avoid vague wording that asks the reader to infer who paid or which content is affected. If commercial material continues below an email break or into a linked page, decide what disclosure each surface needs.

Add conditional branches

If the message may be an invitation or inducement involving a regulated financial product, route it to a named FCA specialist. The FCA's financial-promotions guidance applies independently of the advertising label.

If the edition is sent as direct marketing, record the subscriber type, address provenance, PECR route and suppression. The ICO's electronic-mail guidance does not allow commercial transparency to stand in for permission.

Version, enforce and correct

Store the relationship row, disclosure text, message version, rendered evidence and named approvals together. Reopen review when consideration, control, claim, audience, channel or landing page changes. Set an urgent route to pause a send, remove an archive page, correct a statement and notify affected commercial parties.

Audit a sample by relationship and format, not only by edition count. Record omissions and the repair. Keep publication on hold when the commercial party is unclear, the notice is inaccessible, the evidence file is missing or a specialist gate remains unresolved.

Give contributors a reporting route for undisclosed consideration or changed commercial terms. The policy owner should quarantine the affected copy, preserve what was received and seek the relevant advertising, consumer, FCA, privacy, rights or contract review. Do not punish a reporter by silently editing their record; retain a controlled audit trail and document the final correction.

Before you act

  • Create a row for every sponsor, advertiser, affiliate and gifted input.
  • State the actual relationship in terms a reader can understand.
  • Test disclosure in email, archive, plain text and assistive technology.
  • Complete a disclosure decision record for each affected module.
  • Route regulated financial promotions to a named FCA specialist.
  • Store relationship row, disclosure text and approvals together.

Common questions

What should a relationship register contain for each commercial relationship?

Record the legal parties, consideration, control, payable event, affected editions, start and end dates, rights, evidence owner and contract. Classify support or membership by what the payer receives rather than the publisher's label.

Where should a disclosure notice appear in a newsletter?

Put the notice where the commercial content begins or before the relevant action. Then check the subject line and preview where necessary. Test the disclosure in the email, browser archive, plain-text version and assistive-technology reading order.

When must a disclosure decision be reopened for review?

Reopen review when consideration, control, claim, audience, channel or landing page changes. Also set an urgent route to pause a send, remove an archive page, correct a statement and notify affected commercial parties.
